Esaliens PPK SFIO (“Fund”) provides you with the following information
- The Fund has obtained your personal data in connection with the implementation of the Employee Capital Scheme (“PPK”) with your employer and who has designated you as the person responsible for performing PPK related activities for or on behalf of the employer, including if it has designated you as the administrator of the PPK management agreement concluded with the Fund or as the signatory to the management agreement with the Fund;
- The Fund processes your personal data such as: first name, last name, mobile phone number, email address;
- The controller of your personal data is the Fund as managed and represented by Esaliens Towarzystwo Funduszy Inwestycyjnych S.A. (“Management Company”); the registered office of the aforementioned entities is situated in Warsaw, address: ul. Bielańska 12, 00-085 Warsaw, phone: (+48) 22 337 66 00, email address: info@esaliens.pl.;
- In all matters relating to the processing of your personal data and the exercise of your rights under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), you may contact our Data Protection Officer by writing to: iod@esaliens.pl.
- implementing PPK at the employer’s,
- preparing the above-mentioned PPK management agreement for execution;
- executing the above-mentioned PPK management agreement;
- performing the above-mentioned PPK management agreement and allowing you to submit and receive statements on behalf of the employer in the performance of that agreement – lack of consent for the processing of personal data will prevent the Fund from providing services to the employer or deciding to designate another person as the administrator of the PPK management agreement concluded with the Fund;
- fulfilling the controller’s legal obligations under the Employee Capital Scheme Act of 4 October 2018;
- purposes resulting from legitimate interests pursued by the controller or a third party – on the basis of Article 6(1)(f) of the GDPR – which, according to the controller, include without limitation: direct marketing of services provided by the Management Company and investment funds managed by the same (an up-to-date list of funds is available at www.esaliens.pl), establishment, exercise and defense of legal claims, fraud prevention, statistical and analytical purposes, ensuring the security of the IT environment, using internal control systems. If you do not wish to be contacted for direct marketing purposes, you may object to the processing of your personal data for this purpose at any time. Your objection means that we will not send any marketing communications about the services provided by the Management Company and the investment funds managed by the same.
The controller will process your personal data where such processing is necessary for the purpose of:
Recipients of your personal data may include without limitation:
1) the transfer agent keeping a register of the Fund participants,
2) the custodian performing its duties of safekeeping assets and keeping a register of the Fund assets,
3) the entity intermediating at the conclusion of the above-mentioned PPK management agreement,
4) entities providing the Funds or the Management Company with advisory, accounting, auditing, marketing, mail order, IT, archiving and document destruction services as well as statutory auditors.
Your personal data will be retained for the duration of: performance of the above-mentioned PPK management agreement, fulfillment of the legal obligations incumbent on the controller, establishment, exercise and defense of legal claims for the period resulting from the general limitation periods of claims calculated from the termination of participation.
You have the right to demand from the controller access to your personal data, rectification, erasure or restriction of processing, data portability, as well as the right to lodge a complaint with the President of the Personal Data Protection Office.
